The meaning of certain words used in these terms and conditions
· 'You' or 'your' means the person who either accesses or uses or accesses this Site and/or enters into a contract with Habibis4u Ltd.
· 'Us', 'we' or 'our' means Habibis4u Ltd.
· 'Material' means any data, information, photographs, sounds, images, videos software, data, graphics or text.
· 'Post' (or where the context requires 'Posting' or 'Posted') means you provide or supply to us, or post, send or transmit to, through or onto, the Site or to any other member or user of the Site any Material.
· 'Member' (or where the context requires 'Membership') means that you are allowed to use and Access certain parts of, the Site subject to you complying with the requirements of paragraph 3 below and us accepting that you are Member in accordance with paragraph 4.
· 'Access' means the Posting of Material concerning yourself in a [profile] which is intended to be accessible to others for the Purpose, and your ability to Post a response to the posting of a [profile] by another member of the [Site], and any other subsequent communications between you and another person which is conducted through the Site in connection with the Purpose.

Purpose of this Site
This Site is intended for persons who wish to find marriage partners who are of the Muslim faith (the "Purpose").We will also accept of other faith members who are looking for Muslim marriage partners.

Registration of Membership
To use certain parts of the Site (in particular to have Access) you will need to become a Member in accordance with the procedure described below (including providing the information we require and, where required, making one or more payments). At registration you can select the type of membership you wish to have. The types of membership available, including those requiring payment to be made to us are accessible at (Become a Member ).Note: Certain categories of Membership only permit you to have limited Access (in particular you will not be to have Access as described in paragraph 1.6(b) and (c)).
To become a Member you will need to:
· go to the [registration part of the website];
· completean online form;
· provide a photograph (in the format and in accordance with the specifications at [where located]); and
· for certain types of membership, make one or more payments to us
If a member is contacted by another then it is also their responsibility to ensure that the member that they meet are genuine.We will not be held accountable or responsible if it transpires that a members application is found to be false.
At our discretion, we will decide whether to accept or reject whether you can become a Member.
When you complete and send a form to us you will be confirming and agreeing:
· that you are at least 18 years old;
· that the details you provide about yourself are accurate and true;
· that you will keep those details up-to-date to reflect any relevant changes in those details;
· that the details requested by us will include personal information and data about yourself ('Personal Data');
· that you will be allowing us to post on the Site those details (including Personal Data) which are marked on the form as being publicly accessible and viewable by other users who use the Site;
At the time you complete and send the form you will be asked to choose a username and password. In addition to the matters you are confirming in paragraph 3.4 above you will also be confirming and agreeing that:
· you will keep your username and password confidential;
· you will not supply to anyone else, or allow anyone else to use, your username and password;
· you will let us know as soon as you become aware that anyone other than you has used your username and/or password;
· if you allow anyone else to use either your user name and/or password then you will be responsible for all the activities that they carry out while using them; and
· at the end of each visit to the Site where you are required to use your username and password you will log out, in particular where the computer you are using is or is likely to be accessible by other persons
The legal status of your application for Membership
When you make an application for Membership it is an offer by you to enter into a legal contract with us [(regardless whether the category of Membership you select involves making a payment to us or not)].
Your application to become any type of Member can only be made through the appropriate page on our website (as described in paragraph 3 above). [We do not accept orders made by any other means.]
You and we will only enter into a binding contract when you receive notification from us that we have accepted your Membership and that a binding contract exists from the date and time specified in the notification. The notification will be provided either by email or by letter.
Payment
The prices for certain types of Membership are located on the Upgrade membership tab page of our website. The price you will pay will be that stated at the time you make your application for Membership.
All categories of Membership which require payment by you to us must be paid for in advance, and can only be made with the use of a credit or debit card.
If the payment you make is for Membership for a particular period, we will automatically renew your Membership for a further period and obtain payment from the debit or credit card you specified when you applied for Membership.
Where we have accepted your Membership and have also received payment from you, if the payment is subsequently refused or rejected then we reserve the right
· to refuse to continue Access and/or the Membership; and/or
· to terminate the contract between you and us.
If we decide to increase the price of the type of Membership you have we will notify you in writing either by email or by letter, using reasonable endeavours to give you at least 28 days notice. If you decide you do not wish to pay the increase, you may terminate the contract between you and us in writing.

We may also have free membership access for female members ,please not that this is not for an indefinite period and that at Our discretion we may revert this free membership to one that will require payment.We will informusers when this change is likely to occur via a valid e mail address that is provided by the member.
Your responsibilities
In addition to the matters you are confirming and agreeing to in paragraphs 3.4 and 3.5 above, as a Member you also agree to the matters set out in this paragraph 6.
You confirm and agree that:
· you will only
· use the Site;
· use your Membership;
· have Access; and
· Post Material
· for the Purpose;
· you own or have the right (including intellectual property rights) in or to the Material you Post;
· the Material you Post will not infringe the intellectual property and any other rights of any other person if Posted on the Site;
· the Material you or will Post is not defamatory, abusive, profane, offensive, threatening, racially, sexually or religious discriminatory or hateful or offensive or illegal;
· you will not impersonate any person or entity;
· you will not "stalk" or otherwise harass any person on or through you use of the Site;
· you will not advertise, solicit or contact any other person who uses or is a member of this Site in order to buy or sell any goods or services;
· you will not Post any Material which would be a chain letter, spam or a junk email whether or not addressed to any other user or member of this Site;
· you will not state or imply in any Material which you Post that the Material is endorsed or made by us, unless we give our prior written consent;
· you will use any Material you receive, access or obtain from the Site, us or any other member only for the Purpose, and in particular for no commercial purposes;
· you will not Post any Material that contains viruses, malicious (software) code or which causes harm, changes, limits or disables or destroys the functionality or the purpose of the Site; and
· because of the personal nature of the Membership (that others will or may rely on the Material you have Posted) you will not assign the contract between you and us to another person.

Our responsibilities
We are not responsible for the accuracy, truthfulness, completeness or usefulness of the Material which is provided, supplied or Posted on the Site by any person, including you.
If the Material you Post is or is likely to be in our reasonable opinion to be defamatory, abusive, profane, offensive, threatening, or racially, sexually or religiously discriminatory hateful or offensive or illegal then we shall the right to remove such Material immediately and without notice to you; and/or
where you engage in any activity or make any statement which is or is likely to be defamatory, abusive, profane, offensive, threatening, or racially, sexually or religiously discriminatory or hateful or offensive or illegal or is harassing or amounts to "stalking" then we shall the right to immediately stop you using the Site, including stopping Access or any part which requires you to use your username and password.
At our option we shall have also the right to immediately terminate the contract between you and us.
We shall use reasonable endeavours to provide for the continuous running of the Site, including allowing you to use your Membership and gain Access. However, it will not be possible for us to guarantee or provide that the Site will operate continuously and without interruption, at any particular speed or without error all of the time.
From time-to-time we may have to suspend operation of some or all of the Site, including your Membership and/or Access, sometimes without notice to you, because of a system failure, our need to maintain and carry out repairs, or factors outside of our control (such as, but not limited to, suppliers of services to us which enable us to operate the Site and provide you your Membership and/or Access stopping or withdrawing their services).
We may at time to time monitor members e mails to ensure that there are no spam e mails sent or that they are not sending indecent or offensive messages. We will also monitor the conditions that are attached to the membership and that is at time of writing ,if there is reasonable suspicion that a male member is purporting to be acting as a female and also vice versa then that membership will be terminated forthwith .You agree that you grant us this right and that you by adhereing to these terms and conditions ,grant us and give us permission to monitor all types of communication between members.
Other provisions
The terms and conditions of use of our website, our data protection policy and copyright notices ('Other Provisions') shall be incorporated into these terms and conditions and shall be equally binding on you when you enter into a contract with us.
Termination
We may terminate this Agreement where you are:
in substantial breach of the provisions of these terms and conditions;
in breach of the Other Provisions.
If the category of Membership does not involve payment by you to us then we shall the right to terminate the contract (and your Membership and Access) between us and you at any time and without notice.
If you are in breach of the provisions these terms and conditions and where the category of Membership involves payment to us by you, then we, at our option, may either
offer you an opportunity to correct any breach you have made; or
terminate the agreement
and refund any payments you have made to us and which are in excess of the monthly amount payable for Membership.There will be a small administration charge that will be added if a refunds given.
If we decide to withdraw the Membership part of the Site or make any substantial changes to the service offered to you as a Member, then we will notify you in writing about such withdrawal or change. If we have made a substantial change you shall have the opportunity to continue as a Member. If we withdraw the Membership part of the Site or you do not wish to accept any change and therefore continue as a Member, then we shall refund any payment you have made which is in excess of the monthly amount payable for Membership.
Additionally to the above paragraphs in this paragraph 9, either you or us can terminate the contract between you and us (and your Membership and/or Access) at any time as follows:
· if we wish to terminate the contract we will give you reasonable written notice, and your Membership will terminate at the end of the period you have paid up to;
· if you wish to terminate the contract you may do so at anytime by writing to us and your Membership will terminate at the end of the period you have paid up to.
· If you or we wish to terminate the contract in accordance with paragraph 9.5, but your payment for Membership was a one-off payment (without you needing to make any further payments for Membership), then any notice to terminate will take effect 28 days after the end of the month in which you give notice. [refund any payment you have made and which we have which is in excess of the monthly amount payable for Membership?].
· On the date your Membership is terminated (for any reason), then we will invalidate your username and password and not permit you to use or access any part of the Site which requires you to use your username and password. After the date of termination you will not be able to access, see, copy or use any of the Material you have Posted. [At our discretion, we may provide you with a copy of such of your Material which we still hold or which has not be deleted. On a regular basis we will delete all data of persons who were members.]
Exclusion of liability
Except in the case of death or personal injury caused by our negligence, our liability under or in connection with this Agreement, whether arising in contract, tort, negligence, breach of statutory duty or otherwise shall not exceed the sum of either the amount you have paid for your Membership or ... whichever is the higher.
We shall not be liable to you in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by you:
of an indirect or consequential nature nor
for any economic loss or other loss of turnover, profits, business or goodwill.
Nothing in this Agreement excludes liability for our fraud.
Without prejudice to the generality of the foregoing provisions of this Clause 10, and by way of illustration only, we shall not be liable for the followings losses or liability you may suffer or face caused by your reliance or use of your Membership (or by not relying on or not using your Membership, or by your using or relying them in a reasonable way):
whether you find a suitable marriage partner through your Membership or Access;
whether you find or see on the Site anyone who you will wish to contact;
whether any other person will wish to contact you;
your missing a deadline as to when you wish to marry or carry out any type of activity normally associated with marriage (such as conceive or have children); or
you (or someone on your behalf) suffering loss by reason of the inaccuracy, untruthfulness or incompleteness of any information or data provided to you or which you have seen or obtained through your use or Membership of or Access to the Site;
that you cannot access, use or obtain any Material which you have Posted on the Site following the date the contract between you and us is terminated;
you suffering a business loss or being unable to undertake any business activity;
a third party making a claim against you; or
a government or regulatory authority imposing a fine, penalty or obligation on you through your use of or Access to the Site.
Right to cancel
The Consumer Protection (Distance Selling) Regulations 2000 permits consumers to cancel a contract after it is has been entered into subject to certain limitations and requirements. You will have the right to cancel the contract within 7 days of us informing you that there is a binding contract. However, if you Post Material or make an Access within the 7 day period then you will no longer be able to cancel the contract at the moment you make the Post or make the Access.
If you have the right to cancel then:
you will need to send a notice in writing to us stating that you wish to cancel the contract between us and you; and
you will need to send us the notice of cancellation within 7 working days, with the 7-day period starting with the day after you receive our confirmation that there is a binding contract between you and us;
you can send us the notice of cancellation by e-mail to (info@habibis4u.com) or by post to [Habibis4u ltd,Unity 127 ,Reaver House,12 East street,Epsom ,Surrey,KT17 1HX] marked for the attention of [cancellation team];
after we receive your notice of cancellation we will refund any money you have paid to us within [7] days (where you have paid any money to us for Membership).
General
Contacting each other
If you wish to send us any notice then it needs to be sent to info@habibis4u and should be marked for the attention of Membership Team. If we wish to send you a letter or notice we will use the address you have given at the time you register your Membership.
Reliance on these terms and conditions
We intend to rely on these terms and conditions as being the terms and conditions of the contract between you and us. Any changes to the terms and conditions that you wish to make should be put in writing. but any changes will require our agreement.
Law and jurisdiction
The validity, construction and performance of this Agreement shall be governed by English law and shall be subject to the [non-]exclusive jurisdiction of the English courts to which you and we submit.
Third parties
For the purposes of the Contracts (Rights of Third Parties) Act 1999 [and notwithstanding any other provision of this Agreement] this Agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.
Viruses
Please note that the website maybe subject to viruses from third parties and it is the members responsibility to ensure that any computer used to access the web page has the appropiate antivirus software on it,we do not accept any responsibility if your computer receives a virus or any other form of interference from this web site or its attached links.
Phoographs/Video recordings
By becoming a member you give habibiss4u ltd the right that they may use photograph,video recording,matreial,information in order to copy,perform,reproduce distribute the information and content.We may also use the information for promotional and commercial purposes.
We also reserve the right o monitor all profiles,photographs,video recordings,chat,instant messages and audio recordings to ensure that there is no Breach of Terms and conditions This is to ensure that there is a safe and secure environment .If there is an abuse of the web page then we may take legal action against persons/members concerened and we will pass the information to Law enforcement agencies.
Link pages and special offers
We may allow other parties to display and promote their web pages,in no way do we endorseor reccomend such products or services and we will not be held accountablefor these services.Any special offers that we have for promotional services will be subjcet to the Terms and conditions ,these will normally be of the advertised web link.
